Thank you for choosing Werex Trans for your transportation needs. By booking a shipment with Werex Trans, you (“Customer”) acknowledge and agree to all the following Terms and Conditions (“Terms”).
Werex Trans operates as a licensed transportation broker, arranging the transportation of vehicles, heavy equipment, RVs, freight, boats, containers, and other goods through qualified third-party motor carriers (“Carriers”). Werex Trans is not a carrier and does not own or operate trucks or transport equipment.
In case of any conflict between these Terms and any other document (such as a Bill of Lading or Carrier receipt), these Terms shall control as between the Customer and Werex Trans.
“Carrier” – A licensed and insured motor carrier or transport company contracted by Werex Trans to perform the physical transportation of Customer’s shipment.
“Shipment” – Any vehicle, freight, container, boat, RV, or equipment item arranged for transport by Werex Trans.
“Order” – A confirmed request made by Customer to Werex Trans to arrange transportation.
“Point of Origin” – The pickup location specified by the Customer.
“Destination” – The drop-off location specified by the Customer.
“Bill of Lading” (BOL) – A receipt or inspection report provided by the Carrier at pickup and delivery, documenting shipment condition.
“Customer’s Agent” – Any individual authorized by Customer to act on their behalf at pickup or delivery.
Werex Trans arranges transportation with qualified Carriers to move Customer’s shipment from the Point of Origin to the Destination.
Werex Trans may reject or cancel any order at its discretion.
Werex Trans does not take possession of or control the shipment at any time.
Pickup and delivery dates are estimated only. Weather, traffic, breakdowns, or scheduling issues may cause delays. Werex Trans is not responsible for delays or expenses caused by such events.
Werex Trans’s role is completed once a Carrier has accepted the Order and dispatch has been confirmed.
Accuracy of Information – Customer is responsible for providing accurate shipment details (make, model, size, condition, modifications, etc.). Incorrect or incomplete information may cause additional fees or cancellation.
Shipment Condition – Customer must disclose if the shipment is inoperable, oversized, or modified. Oversized or inoperable loads may require special equipment or rates.
Preparation – Customer must ensure the shipment is ready for transport:
All loose or fragile items are removed or secured.
The fuel level (for vehicles) does not exceed ¼ tank.
Alarms are turned off or instructions are provided.
Personal Property – Limited personal belongings (under 100 lbs) may be transported only with prior approval and must be secured in the trunk or storage area. Neither Werex Trans nor the Carrier is responsible for loss or damage to personal items.
Prohibited Items – Firearms, explosives, hazardous materials, contraband, alcohol, drugs, and live animals are strictly prohibited. Discovery of such items may result in shipment cancellation without refund and potential legal liability.
Port Shipments (if applicable) – For international or ocean transport, the shipment must be empty of all personal property. Customer must provide required export/import documentation.
Carriers will make reasonable efforts to pick up and deliver as close to the specified addresses as safely and legally possible.
If the Carrier cannot reach the address due to restrictions (low bridges, narrow roads, etc.), Customer agrees to meet the Carrier at a nearby safe location.
Customer or Customer’s Agent must be present at both pickup and delivery to inspect the shipment and sign the Bill of Lading.
Any existing damage must be noted on the Bill of Lading before transport. Upon delivery, Customer must inspect for new damages and note them before signing.
Signing the Bill of Lading without noting damage confirms the shipment was received in good condition.
Werex Trans does not require any deposits before pickup.
Full payment is collected only after pickup has been completed and the shipment is on its way to the delivery location.
Customer must not pay the driver or carrier directly unless Werex Trans has given written authorization. Any payment made directly to the carrier without Werex Trans’s approval will not be recognized as valid and may cause delivery delays or additional costs.
Accepted payment methods include Credit Card (3.5% processing fee), Zelle, Cash App, and Wire Transfer.
Any unpaid balances may accrue interest and collection costs if not paid as agreed.
Customer may cancel an order at no charge before a Carrier is assigned.
If cancellation occurs after a Carrier has accepted the order, Werex Trans reserves the right to charge a broker fee of $249 to cover dispatch and administrative costs.
If the Carrier arrives for pickup and is unable to load due to Customer’s actions (e.g., incorrect information, vehicle not ready, no one available), a “dry run” fee may apply.
Refunds, if applicable, are limited to unfulfilled services only.
Werex Trans is a broker, not a carrier, and does not assume cargo liability.
Any damage or loss claims must be filed directly with the Carrier responsible for the transport.
Customer must report any potential claim to Werex Trans within 48 hours of delivery, so Werex Trans can assist with Carrier details and claim process.
Carriers are typically insured per federal regulations. Werex Trans encourages Customers to verify or request additional cargo insurance if needed.
Werex Trans and the Carrier are not liable for damages caused by:
Acts of nature (weather, storms, etc.)
Loose or defective vehicle parts
Personal belongings inside the shipment
Delays beyond Werex Trans’s control
The total liability of Werex Trans, under any circumstance, shall not exceed the amount paid by the Customer for the brokerage services.
Werex Trans provides all services “as-is” and disclaims any implied warranties of merchantability or fitness for a particular purpose.
Werex Trans is not liable for indirect, incidental, or consequential damages such as loss of business, delay costs, or inconvenience.
Any dispute between the Customer and Werex Trans arising from these Terms shall be resolved through binding arbitration in Los Angeles County, California, under the rules of the American Arbitration Association (AAA).
Each party shall bear its own legal fees, unless otherwise ordered by the arbitrator.
These Terms are governed by the laws of the State of California and applicable federal transportation regulations.
If arbitration is found unenforceable, both parties agree that the exclusive venue shall be the state or federal courts located in Los Angeles County, California.
Werex Trans and the Customer act as independent parties; neither is an agent or employee of the other.
If any part of these Terms is found invalid or unenforceable, the remainder shall remain in effect.
These Terms constitute the entire agreement between Werex Trans and the Customer, superseding all prior verbal or written agreements.
Werex Trans reserves the right to update or modify these Terms at any time without prior notice.
By booking a shipment, Customer confirms that they have read, understood, and agreed to all of the above Terms and Conditions.
